News update. Tonight, cops came threatening everyone to leave, and the property owner told everyone that no more car meets will occur there any more. I would talk it over before we go tomorrow night. Tow trucks came tonight to tow any dissobeying cars and the cops were threatening everyone to leave.

Hello Everyone,

Ok I am going to try to clear up some confusion as to what has been happening recently with the Tuesday nights meets. :drama:

There have been many complaints by other businesses :tdown:in the center recently about the car nights (mainly has to do with Tuesday nights, but is causing repercussions for the other nights), some examples ... urinating in the back alley where Subway is, reported narcotic usage, trash, and loitering. Another factor is the the Tues night event was getting a bit out of control and there is a preceived liability issue by the owners of the center. All of this has led us up to where we are now.

Now here is what happened tonight. There was an individual there that was representing the owners of the center and yes there were police present and yes there was a tow truck there as well. This was because many were parked in the 30 MINUTE zone and they were enforcing it. NO ONE GOT TOWED and the POLICE DID NOT BOTHER ANYONE they were just there to help the individual enforce some new policies they would like to implement. Here they are:

1. They will not tolerate loitering any longer in the parking lot. This is not to say that you have to leave immediately after you get to your car, you just cannot hangout for a lengthy amount of time after leaving any of the stores in the center and hang out in the parking lot.

2. 30 Min parking means just that and they are going to enforce this issue.

Now this all really does not affect you guys because most of you all hang out in the cafe or directly outside on the tables anyways. If you are doing this there will be NO ISSUES.

If you guys have any other concerns post them up and i'll try to answer them.

Been gone for 3 and a half months dreaming of boba and cars, but now that bowling league just ended, I'll be in tonight...and I come back to draamaaaa. Should be an interesting evening, but I promise to follow the rules. I'll be there, parked in a non-30 minute spot, front plate ON, windows rolled DOWN, and of course boba in hand! See you all tonight!

CA law says it's illegal to drive a car w/ tint, not just put it on there. So they can't do anything, unless they see you drive it away. ;)

I would know, I was just in court for it

I think there is a bit of confusion surrounding the parking lot. The E30/36 guys are still allowed/welcome to park in the far corner, parking anywhere other than the 30 min parking is not the issue, its just the hanging out/gathering in the parking lot for an extended amount of time is not allowed any longer.

Alright thats it... see you all tonight.

Tonight was such crap. I have patronized all of the food establishments there 3-4 times a week for the past several years, to be treated like snot tonight.

I did NOT appreciate the lone donut patrol harassing me and threatening to tow my car.

I did NOT appreciate my longtime patronage of *all* the restaurant establishments being pissed on, as if I'm not paying them good hard earned money.

I did NOT appreciate some would-be authority telling me I can't park my car in a particular public parking space, when as a paying customer of the shopping center I can park my car in any spot I like. Being discriminated against on basis of having a nice car? What is this a freaking totalitarian leftover corner of Russia that appeared in San Diego?

I'm on a mission. I'm getting the contact info for the owners of the shopping center and writing them a nice letter expressing how displeased I am, and how I will not give business to any shop there that complained about my giving them business by being there. I'm one of those freaks that saves the receipts as well (for tax stuff) so I can prove how much money I've spent there in the past couple years alone, and see if they really want to be telling the people who pay their rent to take a hike.

I will post the information publicly as well as my letter, and anyone who feels so inclined may follow suit with the phone calls and letter writing.

In the meantime, I will not be patronizing any establishments in that center other than Fusion. Screw the sushi place, the mexican place, subway, and the chicken place that's never open anyways. I will be calling the owners/managers of those places as well to express my discontent and let them know they've lost customers.

Kevin -- I love Fusion, but if this continues, I really have better things to do with my time than be treated like a high school street racer up to no good. I have patronized your place since it opened, but I will find a different place to hang out with my car buddies if I have arbitrary time limits imposed on my parking and arbitrary restrictions on my activities on that property. It's on you as well to make this right.

You know, in all honesty, I think tonight was the tightest (as in close) meet we've had in AGES. The fact that we all had to hang out ONLY at Fusion or get worked over by Jabba the Hut really kept the group together.

There's a silver lining to every cloud, ya know?

It wasn't that bad after Kermits pops had a little chit chat with the rent-a-cop. :D :D :D

His dad said that there is NO law saying that you can not stand by your car. Sure it might be a safety issue, but its then your own liability NOT to get hit by a car. So after that, most of us went and chilled in the lot. :) I had fun. I also told Kermit to tell his pops to mess with those dooshbags that came piled up in the SS Chevy SUV or whatever it was. And HE DID! it was great success! Thanks Kermit's dad!

yea it wasnt that bad once the rent-a-cop found out the rules he also chilled it did suck having everyone try and park in the middle though.. and if you are parked in the 30 minute parking outside fusion or near it whos to say that you cant be in fusion or outside there place for longer than 30 min... it was a tight gtg last night but people still had a good time..

I agree with you that it sucks about the flack we're getting as a result of the import night but you parked in a marked 30 minute spot. Doesn't matter if you're eating at the shop or not, the owners have a right to enforce it and they are right now. You were warned like everyone else about the enforcement, =\ so tough cookie there. It's no different then parking on a public parking spot that has a time limit and getting ticketed or towed.

give us the contact info, if you can

Yup, it felt weird, I took my son's Lotus last night and I was coldly eyeballed by the authorities and the businesses. This has never happened before. Nevertheless, I had parked right in front of the Sushi Hut, ordered a meal and sat outside to eat.

To my understanding and dealing with matters similar to this. I have some interesting info regarding this whole “parking ordeal” and “the peaceful assembly” of members to a culturally active automotive club. As a “patron” and/ or customer to any of the food establishments located on the premises, local Law enforcement authorities cannot dictate or enforce where and when to park. If so, it becomes a violation of our Civil Rights. However, I agree that one should observe and adhere to the “posted” and “painted” signage throughout the property…

Because of the established businesses there, the property owners of have intentionally transformed their property into a public square or market area, a public gathering place, a small business district, a “community". The business center there serves as the community business block and is freely accessible and open to the "people" in the area, and those passing through. City authorities may not delegate the power, through the use of its trespass laws, to exclude or remove the members of the public wishing to exercise there rights on the premises in a manner and for the purpose generally consistent with the use to which the property was actually put.

Furthermore, I believe that the name of this particular corner is, "The Mercury Village Business Center".... and one of the definitions of "village" = "community". Therefore, the property owners and/or businesses cannot later deny their own implied invitation to use the space as it was clearly intended. If so, and if one is told to leave because of what kind of car ones drives into the property. It becomes apparent that this is considered a clear case of discrimination and a violation of ones Civil Rights.

The business owners and property owner and/ or there representative have to be “extremely careful”, because
if anyone (regardless of race, color, creed, and car type, car club affiliation, etc…) gets towed or harassed while they are “peacefully enjoying a meal or drink”, that is without a doubt a major $$$$ lawsuit in the making...."seriously".

By the way, I believe the current property owners are...

Mercury Village Owners I, LLC a Delaware Limited Liability Company as to 66-2/3% interest and Mercury Village Owners II, also a Delaware Limited Liability Company owning the remaining 33-1/3%....

I am not sure if either, Brian C. Malk, Peter Zarcades, Sandra Zarcades and Barry Berelowitz still all have some ownership interest in the property. They were all former trustees to the property.

There previous address (1990-2005) was…..

Mercury Village Plaza, LLC
P.O. Box 2457
Del Mar, Ca 92014

The only current (2005 - present) contact info available is…

San Diego Realty Group
Attn: Frank Giordano
P.O. Box 191400,
San Diego, CA 92159

Hope this helps....

Wrong. He threatened to tow my car as I arrived, *not* after I'd been there 30 minutes or more. After 30 minutes, after I'd eaten and had my boba, he was fine with enforcing the 30 minute thing, but it's ridiculous and insulting to approach a patron of a business center in the process of parking legally and tell him he can't park there because of what he's driving or some other discriminatory qualifier.

I parked there anyways to spite him, but I was already pissed.

Anyways, had a nice talk with Kevin this afternoon about the situation (thank you Kevin!!!!!) and it's good to hear the info directly from the source. I will still be writing my letters to the property management and other shop owners to express my displeasure at their new policies, and to give them a history of the shopping center's business development over the past several years, as seen by a regular patron of the center.
