long story short i got a tint ticket a couple months ago along with a speeding ticket but the cop gave me two different tickets
one for speeding cvc 22356 (B)
and one for the tint cvc 26708 (A)
no big deal rite? ill jus fight them like any other ticket; however, he ailed the tint ticket to me claiming it is the owners responsibility which happens to be my dad (the registered owner of the car)
my number one problem is cvc 26708 (A) states: "No person shall drive any motor vehicle with any object or material placed, displayed, installed, affixed, or applied upon the windshield or side or rear windows"
this is a problem because a) my dad doesnt drive the car nor does he ever. and b) he wasnt even in da car when i got pulled over.
so u think thats grounds to have it thrown out?
also my number two problem is i got an extension on the speeding ticket and like a dumbass assumed id get an extension on the tint ticket so the tint ticket went to collections. which sucks because i got the tint ticket signed off but will still have to pay the full fine because the ticket is overdue.
can i see a judge and have any of this reversed/overturned/changed in anyway? at the least being able to pay the corrected fine?
also wut r the penalties for failure to appear on a fix it ticket?

seeing a judge is pointless they will ALWAYS side with the cop
like that tint, loud stereo and front plate ticket i got awhile ago also i was found guilty on all 3 charges even tho i had physical proof for 2 of them.
...BUT! fortuently some how the system lost my ticket and theirs no proof of me having those violations ( ive been to the courthouse 3times already and each time they werent able to pull anything up)

well technically the tint ticket is invalid becuz its supposed to be in my name since i was driving the car

also the cop wont be there cuz the ticket dude date was 1/16/08 its almost a month overdue

I don't think the fact that the car is registered in your dad's name and the tint ticket is in your name is going to matter. In fact I am almost positive.

Yeah, won't matter, because the registration is probably in your dad's name the law states "owners responsibility" . . . so technically it is your dads problem.
Now with that said, it doesn't mean that you can't take care of the ticket and handle everything yourself. But it does not make the ticket invalid because it's not in your name even though you were the only one present in the car.

nice try, tint ticket stays.
see a traffic judge and plead your case to her or him, but odds are, you are SOL.

yea I figured as much hopefully they'll let me see the judge becuz I'd rather pay a ten dollar fix it fine then the full 130+ dollar bail

Good luck, your interpretation of the law doesn't excuse you being past your bail date.
You can always plead your case and mention to the judge that you were waiting on responses from an Internet forum for advice. :D
But seriously, good luck.

my tint ticket got me in all kinds of trouble, got my license suspended and such
but when i went to see the judge i kinda said the violation was for my cracked windshield... so i kept my tint and my windshield is just a $10 write off now, and she dismissed my registration/insurance violations w0ot!

mine was in collections too (the tax board sent a letter to my employer to garnish my earning) i went 6 mos late, with a suspended license and got over 50% reduction on my fines from 2 different courts in 1 week
did you talk to a normal clerk? if so, make sure you speak with the collections dept instead.
jwill'sMK4
02-14-2008, 02:45 PM
apparently this court operates differently from the other courts ive been to according to the clerk the ticket is in collections and i cannot see a judge at this point
side note i turned in my not guilty plea and they clerk didnt even take it to file it and i had to sign a bunch of forms and stuff stating my rights and wut i was agreeing to
also the clerk made me pay the bail up front in full
which was weird cuz the 2 written decs. that i did in riverside county i had until the due date of my fine to pay bail and when i said something about she was like no u have to pay the bail now or come back and see the judge on the due date

i cant afford it this month lol maybe next month will be a better month
hey do the put out warrants for overdue tint tickets cuz i might need to warn my dad lol
and really its all his fault the car was supposed to be registered in my name last yr but he procrastinates like a mofo
oc-audica
02-14-2008, 02:50 PM
i've gotten warrants for it before, but i didn't this last time as i had 2 outstanding tickets with several violations for over 6mos (however my license was suspended for failure to appear)
failure to appear/failure to pay = $300 fine
and your pops won't get any heat unless his name is on the ticket i think

You can shift blame all you want, what you may want to do it try to go to court and explain the situation and ask for a payment plan.

PS: if you DO ever happen to make it in front of the judge, i would recommend NOT making that argument (about the tint). . . it will probably just make the judge mad. . . just go up in front of her/him, be apologetic and remorseful and leave yourself to the mercy of her/him. . . at worst, she will tell you to pay $439. At best, she will lower it a little.
also, dress up. don't show up wearing shorts and a t-shirt.

first off wut arguement. the arguement that i gotta the tint corrected and signed off?
and second i was hoping to see the judge today i went up there in in dress slacks/shoes/shirt tucked in with a belt hahaaha i almost wore a blazer but i thought that would be a lil much plus uncomfortable
side note some girl was crying cuz she got her license suspended for a yr i wanted to tell her its ur fault its suspend y cry about it i remember i was one point away from gettin mine suspended and getting close was all it took to keep me out of trouble for 3 yrs

WOW !!! Way to take a $10 fix-it and flux it. Wife got hassled for her tint 3 times. After the 3rd time she finally took it off. Wasn't worth the headache. So now she can drive without having to worry about getting lit up by the fuzz. Unless she's pushing the wrong side of the speed limit.
Should have just had the tint removed and coughed up the $10. In the alotted time frame. Live and learn. Happy motoring.
