SOUTH CHARLESTON, West Virginia — A West Virginia man is facing charges and he thinks it stinks.
Police have charged 34-year-old Jose Cruz with battery on a police officer for allegedly passing gas and then fanning it towards an officer.
Police say Cruz was pulled over early Tuesday for driving without headlights.
The criminal complaint says Cruz allegedly smelled of alcohol, had slurred speech and failed three field sobriety tests before he was handcuffed and taken to a police station for a breathalyzer test.
The complaint says as the officer prepared the machine, Cruz allegedly scooted his chair toward him, lifted his leg and “passed gas loudly.”
Cruz, according to complaint, then fanned the gas toward the officer.
The complaint says the gas was very odorous and created contact “of an insulting or provoking nature” with the officer.
Cruz acknowledged passing gas, but says he didn’t move his chair toward the officer nor aim the gas.
He says he had an upset stomach at the time, but police denied his request to go to the bathroom when he first arrived at the station.
He says — quote — “I couldn’t hold it no more.”
